BY USING THIS SERVICE, CUSTOMER ACKNOWLEDGES THAT HE/SHE HAS READ AND UNDERSTOOD FULLY THE TERMS AND CONDITIONS OF THESE SPECIFIC TERMS, AS WELL AS MPT’S GENERAL TERMS AND BINDS HIMSELF/HERSELF TO ALL THE TERMS AND CONDITIONS THEREIN.
This page explains the terms by which Customer agrees to abide by when using MPT IPTV service, website and/or software provided through or in connection with MPT IPTV (collectively, the “Service”).
By using this Service, Customer signifies that Customer has read, understood, and agree to be bound by these Specific Terms and Conditions (for MPT IPTV Service) and any other applicable rules, policies and terms associated therewith (Collectively, the “Specific Terms”). These Specific Terms are to be read in conjunction with MPT’s General Terms and Conditions (the “General Terms”) and MPT’s Privacy Policy (“Privacy Policy”) which shall form an integral part of these Specific Terms. If there is any conflict between the Specific Terms and the General Terms / Privacy Policy, the provisions of the Specific Terms will supersede the provisions of the General Terms only to the extent of the inconsistencies.
1. Definitions
Capitalized terms contained herein but not specifically defined as follows shall have the same meaning as those set out in the General Terms:
(a) “Application” or “App” means Android or iOS application which can be used for MPT IPTV service;
(b) “MPT IPTV”, “We”, “Our” and “Us” mean MPT, and its subsidiaries, agents, employees, successors and assigns; and
(c) “Service” means the IPTV service provided by MPT which allows Customers to subscribe and watch content, TV channels and movies.
2. Service Description
2.1. MPT IPTV Service allows Customer to watch and access MPT IPTV service’s TV channels, movies, and other MPT IPTV information. All rights not expressly granted to Customer in these Specific Terms are reserved and retained by us or our licensors, suppliers, publishers, rights holders, or other content providers. Customer may use the Service only as permitted by these Specific Terms and by law; all other uses are strictly prohibited.
2.2. Customer’s use of the Service is subject to scheduled and unscheduled service interruptions. Customer agrees that MPT IPTV will not be liable to Customer or any third parties for any interruption of the Service, downtime (planned or unplanned) or access failure.
2.3. MPT IPTV shall have no liability for Customer’s use or misuse of the Service, any interactions Customer have with other users, or any other act or omission by Customer regarding the Service.
3. Video resolution
Resolution of video content can be affected by the format of the content we receive, the quality of the Internet connection used and device screens used, and other reasons.
4. Security.
The Services, and the Application include a security framework using technology that protects digital information and limits Customer’s access to only those Services which the Application is designed to access, perform, display or link to and, if applicable, which Customer has purchased. Therefore, certain features of the Application may not be available if Customer has not purchased the applicable Services. Such technology is an inseparable part of the system within which the Services, and the Application interact, and communications between the Services, and the Application may be controlled and monitored by MPT to ensure that such technology operates properly. MPT reserves the right to modify the technology for the Service at any time.
Customer agrees not to use the Service for any reason other than its intended purpose.
For the avoidance of doubt, the following is not permitted: copying, attempting to or encouraging or assisting any other person to, circumvent, modify, remove, alter, deactivate, degrade or thwart any of the content protections of the Service; reverse-engineer, decompile, disassemble, any software or other products of processes accessible through the Service; insert any code or product to manipulate the contents of the Service in any way or otherwise tamper with such technology, or any part thereof, for any reason whatsoever, including to obtain unauthorized access to the Services. Any such act by Customer may constitute copyright infringement and may result in civil or criminal liability.
5. Paid Services
5.1 Billing Policies. Certain aspects of the Service may be provided for a fee or other charge. These fees and charges, if any, are described on our MPT IPTV website.
If Customer elects to use paid aspects of the Service, Customer agrees to the pricing, payment and billing policies applicable to such fees and charges, posted at the website. MPT may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion.
We will charge Customer for making the following processes:
a) Subscription: When Customer subscribes to content through the Service, we will charge Customer. Upon payment of the subscription fee, Customer can view all content included in the subscription for one (1) day. Subscriptions, and charges therefor, automatically renews unless Customer unsubscribes. In case of a free trial, after expiration of the free trial, Customer will be charged the applicable subscription fee automatically unless Customer unsubscribes.
The content included in a subscription may change from time to time as determined by MPT in its sole discretion.
In addition to the foregoing, data charges may apply for Customer’s use of the Service, including any downloads with respect to the Service.
5.2 No Refunds. Customer may cancel Customer’s Service account at any time, however, there are no refunds for cancellation.
In the event that we suspend or terminate Customer’s Service account, Customer understands and agrees that Customer shall receive no refund or exchange for any unused time on a subscription, any license or subscription fees for any portion of the Service, any content or data associated with Customer’s MPT IPTV account, or otherwise.
Customer acknowledges that we have the perpetual and irrevocable right to delete any or all of Customer’s content and data from our servers and from the Service, whether intentionally or unintentionally, and for any reason or no reason, without any liability of any kind to Customer or any other party.
6. Ownership of the Service and Reservation of Rights.
The Service is protected by copyright and other laws and international copyright and other treaties. All title and intellectual property rights in and to the Service and all modifications, updates, upgrades, supplements, enhancements and derivative works of the Service are owned exclusively by MPT or its licensors. Certain third-party software used in connection with the Service may be made directly available to Customer by the providers thereof. Use of such software is also subject to the terms of any applicable agreement between Customer and each such provider. MPT reserves all rights in and to the Service not expressly granted to Customer under this Specific Terms.
7. User Account
If Customer would like to use the Service in conjunction with certain Services which have been authorized by MPT to be accessed from, performed by, displayed on or linked through the Service, Customer needs to establish a user account or with such other MPT IPTV website through which the Services may be accessed (the “Account”). The Service will use information included in Customer’s Account to perform some of its functions and enable access to some of its features. Therefore, such features may not be available if Customer does not establish an Account.
Customer is solely responsible for the information Customer provides when Customer establishes its/his Account, and for maintaining the confidentiality and security of the Account and the password created to access such Account. Customer should not reveal Customer’s Account information or password to another person. Customer shall not access or attempt to access an Account that Customer is not authorized to access.
Customer is entirely responsible for all activities that occur on or through Customer’s Account, and Customer agrees to immediately notify MPT of any unauthorized use of the Account or any other breach of the security of the Account. MPT shall not be responsible for any losses arising out of the unauthorized use of Customer’s Account.
8. Customer Data
In addition to the terms of MPT’s Privacy Policy, the following terms on the collection, use, disclosure of Customer Data will apply:
8.1 When and what information is collected?
User-Provided Information: You provide us information about yourself, such as your name and phone number, when you register with and use the Service. If you correspond with us by phone, we may retain the content of your phone messages, your phone number and our responses.
Cookie Information: When you use the Service via the web, we may send one or more cookies – a small text file containing a string of alphanumeric characters – to your device that uniquely identifies your browser and lets us help you log in faster and enhance your navigation through the site. These cookies may store the following information:
phone number, network type, sign in authentication and language selection.
We use necessary cookies to make our site work. We’d also like to set optional analytics/performance cookies to help us improve it.
Log File Information: Log file information is automatically reported by your browser each time you access a web page. When you register with or view the Service site, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information.
We may also collect the following information from you when you use the Service:
• Search queries (such as what you click on or search for, and voice commands or other inputs when navigating the Website or Application);
• Device location, such as from IP address or Wi-Fi (“Your Device Location Information”);
• Unique identifiers, such as Account ID / Mobile Number;
• How you connect to the internet, such as the Wi-Fi connection you use;
• What videos, stations, or programs you watch and when;
• Billing Address;
• Demographic Information (e.g., through registration);
• Subscription Plans for MPT IPTV accounts linked to the Application;
• Device type and operating system;
• Connection type; and
• Software.
8.2 How might we use your information
• We may use the information to:
– deliver and improve the Service;
– tailor your viewing experience, including things like making recommendations on the content to be viewed;
– conduct analytics;
– recommend and market products and services of MPT or third parties that may be of interest to you;
• Without Your Device Location Information, we may not be able to provide access to certain services and features like regional sports programming, local weather, local programming, live local channels or other content with geographic restrictions. If you disable location tracking on your device, you acknowledge and agree that the Application/Website may determine your location, such as using your public IP address, to determine your general location for purposes of delivering services, such as the channel guide.
8.3 Disclosure of Information
• We may share information collected through the Service with the following:
o Other companies within the MPT family of companies, including any of our affiliates (including those that may not share the MPT IPTV or MPT brands);
o Programmers and networks who provide the programming that you watch through the Service; and
o Third parties for their advertising or marketing uses. This information may include general interests (for example a sports lover); specific interests (for example a basketball fan of a specific team); and other information collected about you. When we share data with third parties, we use identifiers such as your Android advertising ID.
• When we say “third parties” with whom we share data, we mean parties such as advertisers, programmers and networks, social media networks, analytics firms (companies that measure and analyze consumer behavior), ad networks (companies that deliver and track ads for advertisers across numerous websites, applications and devices), and other similar companies that are involved in creating and delivering advertisements.
• Your information may be anonymized and used in or shared to compile aggregate reports, such as a report on how many people searched for a certain television show or reports we may sell to other companies for their own marketing, advertising or other similar uses. Since the aggregation of personal information is anonymized, the information about you being used will not identify who you are.
9. Our Proprietary Rights
Any MPT proprietary material related to the Service, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and content (collectively, “MPT Content”), and all intellectual property rights related thereto, are the exclusive property of MPT. Except as explicitly provided herein, nothing in this Specific Terms shall be deemed to create a license or right in or under any such intellectual property rights, and Customer agrees not to sell, license, rent, modify, distribute, copy, reproduce, reverse engineer, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any materials or MPT Content accessible on the Service. Use of the MPT Content for any purpose not expressly permitted by this Specific Terms is strictly prohibited.
10. Termination
MPT may suspend or terminate any Service at any time with or without notice to the Customer and without liability. Upon Service suspension or termination, Customer shall cease all use of the Application.
MPT will not be liable to Customer or any third party for compensation, indemnity, or damages of any sort as a result of any suspension or termination of the Services, and such suspension or termination will be without prejudice to any other right or remedy MPT may have, now or in the future.
11. Limitation of Liability
In addition Clause 8 of the General Terms, the Service is provided “as is” and without warranty or condition.
12. Indemnification
Customer shall indemnify, defend and hold harmless MPT and its collaborators, suppliers and licensors, and their officers, directors, agents and employees (the “Indemnified Parties”) from and against any claim, proceeding, loss, damage, fine, penalty, interest and expense (including, without limitation, fees for attorneys and other professional advisors) arising out of, in connection with or related to the following: (i) Customer’s breach of this Specific Terms; (ii) Customer’s violation of law; (iii) Customer’s negligence or willful misconduct; or (iv) Customer’s violation of the rights of a third party.
Customer will promptly notify MPT in writing of any third-party claim arising out of or in connection with Customer’s use of the Service. These obligations survive termination of the Services.
13. Miscellaneous
13.1 Contact Information. Customer may reach MPT IPTV Customer Service by calling 106 to speak to a representative.
13.2 Electronic Communications. We may communicate with Customer via Customer’s contact such as the phone number registered with Customer’s Account.
Customer hereby consents to receive such communications and agree that any communications sent to Customer to the email address registered with Customer’s Account will satisfy any applicable legal notice requirement.
It is Customer’s responsibility to notify MPT of any changes to Customer’s email address and MPT shall have no liability resulting from Customer’s failure to receive any communication sent to the email address registered with Customer’s service account unless MPT receives written notice from Customer of a change to Customer’s email address.
13.3 Severability. If any provision of this Specific Terms is held to be invalid or unenforceable, the remaining provisions shall not be affected and shall remain valid and enforceable to the fullest extent permitted by law.
13.4 Waiver. Except as provided herein, the failure to exercise a right or require performance of an obligation under this Specific Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute waiver of any subsequent breach.
13.5 Assignment. Customer shall not assign or transfer any Customer Agreement or any of the rights or obligations granted therein without the prior written consent of MPT.
13.6 MPT may transfer all or any part of MPT’s rights, interests and obligations under any Customer Agreement to an Affiliate, successor or third party.
13.7 Modification or Amendment. These Specific Terms may be amended and updated by MPT from time to time and shall take effect upon the date of notice or publication, or as otherwise specified by MPT. Notice of such amendment or update to the Specific Terms may be provided to the Customers in any reasonable manner as determined by MPT and includes posting to the MPT website or MPT IPTV website.
13.8 Survival. Following the expiration or termination of the Customer Agreement, whether by its terms, operation of Law, or otherwise, the terms and conditions set forth, as well as any term, provision, or condition required for the interpretation of the Customer Agreement or necessary for the full observation and performance by each Party thereto of all rights and obligations arising prior to the date of termination, shall survive such expiration or termination.
